澳門大學 2019 年榮譽學位及高等學位頒授典禮 澳門大學榮譽法學博士 喬曉陽先生 感言 2019 年 11 月 9 日 女士們、先生們、同學們： 大家下午好，剛才劉羨冰女士的講話代表了我們幾位的心聲，謝 謝劉老師。本來我可以不再講話，但作為唯一從內地來的人，還是想 佔用幾分鐘，講一講我與澳門大學的緣份，對澳門大學的特殊感情。 今天上午我在澳門大學法學院的講座上已經講了一遍，林主席、宋校 長聽到了這段講話，但我想在座的許多人沒有聽到。我和澳大的這個 緣份的起因是，2008 年中央同意澳門大學在橫琴島設立新校區，需要 由全國人大常委會作出授權決定，我當時擔任全國人大常委會副秘書 長、澳門基本法委員會主任，所以由我負責研究處理與授權決定有關 的法律問題。可以說，從澳門大學新校區的選址、奠基、建設到開學 正式啟用，我參與了全過程，曾經六次來到這個地方，親眼見證了這 裡從一片農地變成充滿活力的大學校園，親身經歷了澳門大學這一段 重要的發展歷程。也許是這個原因，在澳門回歸 15 周年之際，2014 年 5 月 9 日你們邀請我在首次啟用的澳門大學新校區大禮堂發表了 一次演講，於是我成為第一位在這個講壇發表演講的人，我深感榮幸。 更加榮幸的是，我與澳門大學的這段緣份、這份感情還在延續， 今天，在澳門回歸 20 周年之際，你們授予我澳門大學榮譽法學博士， 從而使我成為澳門大學的一員。今天上午我對同學們說，你們以後在 介紹我的時候，可以不再需要用“嘉賓”的稱呼了，因為我來到這裡， 已經不再是客人。而且我告訴同學們，作為“澳大人”的感覺真好， 看到你們的青春風采，看到校園的朝氣蓬勃，我的心也年輕了！ 與此同時，我也要向大家袒露心跡，你們授予我澳門大學榮譽法 學博士，我是十分忐忑不安的，自認為很不夠格，因為我不是法律科 班出身，我的本科是外語，學的是西班牙語，是在 1964 年到 1967 年 在古巴哈瓦那大學文學系學的，回國後起初在外事部門從事翻譯工作， 對於法律我屬於半路出家。我是 1983 年到全國人大才開始參與法律 工作的，到 2018 年退休，整整 35 年。我的那點法律知識是到全國人 大工作後逐漸學習積累的，先是在法制工作委員會從事立法工作，後 來到基本法委員會從事基本法研究實施工作，最後到法律委員會從事 法律案的統一審議工作，一路走來，從事的主要是法律實務工作，對 1 法學理論的研究實在差的很遠，所以授我榮譽法學博士實在有些愧不 敢當。我只能把你們授予我這個榮譽當作是對我的鼓勵和鞭策，當作 是對內地所有從事法律工作的同仁們的褒獎，衷心的感謝你們！同時， 我還要借這個機會感謝我的太太盧紅生，一路走來對我的工作支援和 照顧，她今天也來到現場，和我的女兒欣欣、女婿李松、外孫小虎子、 外孫女小龍女以及幾位專程從內地和香港來的朋友，一起見證這個榮 幸的時刻。再次謝謝大家。 2 Ceremony for the Conferment of Honorary and Higher Degrees 2019 by the University of Macau Speech by Mr Qiao Xiaoyang, Recipient of the Doctor of Law Honoris Causa 9 November 2019 Ladies and gentlemen, dear students, Good afternoon. I would like to thank Ms Lau Sin Peng for conveying our thoughts and feelings in her speech just now. I thought I might not have to deliver a speech here. However, as the only recipient from the mainland, I decided to talk briefly about my association with the University of Macau (UM) and my special connection with UM. I talked about this in the morning during the seminar at the Faculty of Law. Chair Lam and Rector Song heard the speech but I believe most of you did not. My association with UM began in 2008 when the central government approved the setting up of a new campus in Hengqin Island for the university. This decision needed a mandate from the Standing Committee of the National People's Congress (NPC). Back then, I was the deputy secretary-general of the NPC Standing Committee and chairman of the Basic Law Committee for the Special Administrative Region of Macao. I was responsible for studying and handling the legal issues related to this mandate. From site selection, laying the foundation stone, construction to the formal inauguration of the new campus, it can be said that I was involved in every stage of the process. I have been here six times, and have witnessed this place transforming from an unremarkable piece of farmland into a vibrant university campus. I experienced this important chapter in the development of UM first-hand. Perhaps that is the reason why, at the 15th anniversary of the return of Macao to China, on 9 May 2014 I was invited to give a talk at the opening of the University Hall in this new campus. I was very honoured to be the first speaker on the stage. I feel even more honoured that my association with UM continues, as does attachment to it. Today, at the 20th anniversary of the return of Macao to China, UM is conferring upon me the degree of Doctor of Law honoris causa, which essentially makes me a member of the university. This morning I told the students that as such, you no longer need to address me as a guest when introducing me, as I was not a guest anymore. I also told the students that I feel pleased to be a UM member and that seeing faces full of youth and promise and the campus so lively and vibrant, I myself felt younger as well. That said, I must confess to you that I have ambivalent feelings towards the honour bestowed by the degree of Doctor of Law honoris causa as I see myself as inadequate. I do not hold a law degree, but studied Spanish as an undergraduate in the Department of Arts and Letters of the University of Havana in Cuba between 1964 and 1967. After my return to China, I worked as a translator in a foreign affairs department. You can 1 say that I have never received any formal training when it comes to law. It was not until the year 1983 when I joined the NPC that I became involved in legal work. Since then, I stayed in the field for 35 years until retirement in 2018. The little knowledge of law that I have mostly came from my work at the NPC, where I was tasked with handling legislation in the Legislative Affairs Commission, study and implementation of the Basic Laws in the Basic Law Committees, and finally work regarding the standardisation of case judgement in the Legal Committee. For the whole time, my focus was on legal practice, and I still have a long way to go in the theoretical study of law. Therefore, I must say that you flatter me way too much with the award of the Doctor of Law honoris causa. I will however regard this honour as an encouragement and incentive to me, and an accolade to all of the legal practitioners in the mainland. Please accept my sincerest gratitude. I would also like to thank my wife Lu Hongsheng for supporting my work and being by my side throughout the years. She is also here today, accompanied by my daughter, son-in-law, grandson and granddaughter. Some of my friends from the mainland and Hong Kong are also present to witness this glorious moment for me. Thank you all for coming. Thank you very much. 2 Cerimónia de Outorga dos Graus Académicos Honoríficos e de Pós-graduação 2019 da Universidade de Macau Palavras do Dr. Qiao Xiaoyang na Cerimónia de Atribuição do Doutor honoris causa em Direito 9 de Novembro de 2019, à tarde Minhas senhoras e meus senhores, Caros estudantes, Boa tarde. Obrigado, Prof.ª Lau, pelo excelente discurso, que exprimiu todo o que queríamos dizer. Eu podia não falar. Mas, como sou a única pessoa vinda do interior da China entre os doutores honoris causa, queria utilizar alguns minutos para falar sobre a minha ligação e sentimento especial para com a Universidade de Macau. Já fiz um discurso na parte da manhã, numa conferência realizada na Faculdade de Direito, a que assistiram o Presidente do Conselho Doutor Lam e o Reitor, Prof. Doutor Song. Mas muitas pessoas aqui presentes não ouviram o meu discurso. A minha ligação com a UM começou com o seu novo campus na ilha de Hengqin. A delegação de poderes de jurisdição sobre o novo campus tinha de ser aprovada pelo Comité Permanente da Assembleia Popular Nacional, razão pela qual fui envolvido nos assuntos jurídicos relacionados com esta questão, pois naquela altura desempenhava as funções de secretário-geral-adjunto do Comité Permanente da Assembleia Popular Nacional e de presidente da Comissão da Lei Básica da Região Administrativa Especial de Macau deste Comité. Posso dizer que participei em todo o processo relacionado com este campus, desde a selecção do sítio e o lançamento da primeira pedra até a sua construção e entrada em funcionamento. Estive aqui seis vezes e testemunhei a transformação de uma plantação agrícola num campus universitário dinâmico, uma parte importante da história da Universidade de Macau. Talvez por isso convidaram-me, por ocasião do 15.º aniversário do estabelecimento da RAEM, para fazer um discurso no dia 9 de Maio de 2014, na Aula Magna no novo campus da UM, que, na altura, acabou de entrar em funcionamento. Senti-me privilegiado por ser o primeiro conferencista a utilizar este espaço. Mas o meu privilégio vai para além disso, pois continua a minha ligação e o meu afecto para com esta instituição. Hoje, por ocasião do 20.º aniversário da RAEM, a UM atribuiume o grau de doutor honoris causa em Direito, fazendo com que me tornasse um membro da UM. Hoje de manhã, eu disse aos estudantes que, quando me apresentarem, já não precisam de me tratar por “convidado”, porque já sou membro desta casa. Disse-lhes também que é muito bom ser um membro da Universidade de Macau. Sinto-me mais jovem ao ficar no meio de estudantes enérgicos e neste ambiente tão dinâmico. Tenho de confessar a minha inquietação ao receber este doutoramento honorífico em Direito. Não me considero merecedor deste título, pois não me licenciei em Direito, mas sim em língua espanhola. Estudei esta língua em Cuba, no Departamento de Literatura da Universidade de Havana, entre os anos 1964 e 1967. Depois de regressar à China, trabalhei como tradutor num departamento de assuntos estrangeiros. Só tive o meu primeiro contacto com Direito em 1983, ano em que integrei a Assembleia Popular Nacional. Trabalhei na área jurídica durante 35 anos, até à minha aposentação em 2018. Os meus limitados conhecimentos neste campo vieram acumulando aos poucos na Assembleia Popular Nacional. No início, participei nos trabalhos de legislação na Comissão dos Assuntos Legislativos, tendo-me envolvido posteriormente nos estudos e implementação das leis básicas e na apreciação das propostas de lei, na Comissão da Lei Básica e na Comissão dos Assuntos Jurídicos, respectivamente. Os trabalhos que fiz são principalmente relacionados com Direito na sua vertente prática, que fica longe de ser uma investigação académica em Direito. Neste sentido, não mereço este elogio tão grande. De qualquer maneira, penso que esta honra servirá como um encorajamento para mim e um elogio para todos os colegas no interior da China que trabalham na área jurídica. Muito obrigado! Por fim, gostaria de aproveitar esta ocasião para agradecer à minha esposa Lu Hongsheng, pelo apoio e companhia ao longo dos anos. Ela está aqui presente, juntamente com a minha filha, genro e os meus netos, assim como os amigos que vieram especialmente do interior da China e de Hong Kong, para testemunharem este momento glorioso.
